Guest Lecture on 'Practical Aspects of White-Collar Crimes'

The School of Law, CHRIST (Deemed to be University), Pune Lavasa Campus has organised a guest lecture on 24th September 2022 from 9:00 AM to 10:30 AM for all third year and fourth year law students on the topic ‘Practical Aspects of White Collar Crimes’ by Adv. Ashwinkumar Arulaananthan, founding partner of AMS Legal and an alumnus of CHRIST (Deemed to be University), Bangalore.

Ashwinkumar Arulaananthan is a founding partner of AMS legal. He is an experienced legal practitioner with a demonstrated history of being skilled in dispute resolution and strategic legal consultations for body corporates and HNIs. He is one of the most sought-after lawyers for cases involving complex factual disputes and questions of law. Ashwinkumar has extensively appeared and argued in various Judicial and Quasi-Judicial forums across the country in high-end commercial disputes and large-scale criminal liabilities. His core practice includes handling matters relating to Securities Frauds, Corporate Criminal Liabilities, Financial frauds by NBFCs & breach of Cyber Security. Besides being a renowned litigator appearing for and against Body Corporates and HNIs, He has been recognised and appointed in various positions in Committees & Commissions appointed by High Court of Madras. He has rendered service as Legal Aid Counsel in over two dozen cases on Suo Moto direct appointment by the orders of High Court of Madras. He was also appointed as one of the election officers in various election commissions by Madras High Court including the Election commission for film and television producers guild of South India.

White collar crimes are non-violent form of crimes that usually involves deceit or concealment to obtain or avoid losing money or property or to gain personal or business advantage. Certain examples of white collar crimes are Securities fraud, embezzlement, corporate fraud, and money laundering. Corruption, fraud, and bribery are some of the most common white collar crimes in India. Major reasons behind growth of these crimes are greed, competition and lack of proper laws in the country. People who commit these crimes do it meet their own needs and needs of the family. White collar crimes have effects over the company, employees, customers and society at large. Various committees have been formed throughout the years to look into these crimes such as the Report on the Commission on the Prevention of Corruption 1964, The Report on the Commission of Inquiry on the Administration of Dalmia Jain Companies 1963, Das Commission Report, 1964. There are various types of white collar crimes such as blackmailing, covered under section 503 of the Indian Penal Code, credit card frauds, and currency schemes. Laws relating to white collar crimes are Essential Commodities Act 1955, the Industrial (Development and Regulation) Act, 1951.The Import and Exports (Control) Act, 1947, the Foreign Exchange (Regulation) Act, 1974, Companies Act, 1956, Prevention of Money Laundering Act, 2002.
